Robert Marcus is a commercial mediator and solicitor with more than 30 years’ experience advising businesses on commercial, contractual and corporate matters.

A founding partner of Jurit LLP and a member of the Chartered Institute of Arbitrators (MCIArb), Robert has worked both in private practice and in-house, giving him a strong understanding of the legal and commercial issues that sit behind business disputes.

As a mediator, he focuses on helping parties understand where their interests align, assess the strengths and risks of their respective positions and find a practical way forward.

Robert mediates commercial and contractual disputes, including partnership and shareholder matters, technology and IT disputes, maritime and insurance matters, and disputes involving renewable energy.

Commercial and in-house experience

Robert’s career spans private practice and senior in-house roles in the UK, Europe and Australia.

Earlier in his career, he advised on contentious maritime and insurance matters for major law firms. He subsequently spent more than 20 years working in-house at IBM, where he supported complex technology projects and worked closely with business teams on the legal and commercial issues they faced.

That experience gives Robert an insight into disputes from both sides - as a lawyer advising on contentious matters and as someone who has spent much of his career working within a major international business.

He understands that the considerations surrounding a dispute often extend beyond the legal arguments. Cost, management time, commercial relationships, reputation and future business opportunities can all influence the decisions parties make.

Technology mediation

Technology is a particular area of interest for Robert, drawing on his extensive experience at IBM and his wider work advising businesses on technology and innovation.

He acts as a technology mediator in disputes involving technology providers, customers, business partners and other stakeholders. His experience enables him to get to grips with technically complex matters while keeping the mediation focused on the issues that need to be resolved.

Robert also has experience in renewable energy and is well placed to mediate disputes involving the intersection of commercial contracts, technology and innovation.

Approach to mediation

Robert takes a straightforward and constructive approach to mediation. He works with each party to establish the issues that matter, test their respective positions and explore whether there is sufficient common ground to reach an agreement.

His aim is not simply to resolve the legal challenge, but to help identify an outcome that makes sense in a wider commercial context.
